Thank you for your bug report. Not having a trash there is the expected behaviour right now because the user doesn't own the exclusive permissions on the drive, do you think it's wrong, why? Don't specify hardy to the bug title, the information will be incorrect when hardy+1 opens and creates confusion and extra work, the bug should be closed if it's fixed in hardy and you can use the description
