zoom maximized window in scale will be part blocked by unity panel and launcher

to reproduce
open any window maximized, enter scale mode, 'zoom' that maximized window using right click (from scale addons), the window will zoom to almost full screen and unity launcher/panel will be on top of it.

kinda like this bug https://bugs.launchpad.net/ubuntu/+source/unity/+bug/778729 but that doesn't happen when I set launcher to 'never hide', this happens even it's 'never hide'

the correct way would be for compiz to acknowledge unity launcher/panel all the time whether it's set to hide or not, since they are going to show when scale is initiated.

I do not really thinks it's a classic bug.
Anyway I would like it to be changed.

I commented on https://bugs.launchpad.net/ubuntu/+source/unity/+bug/778729 #5, and that bug still closed as "won't fix".
