window's top border go under unity panel when restored from maximized state unless using grid

Bug Description

Binary package hint: compiz

Any window that is at the top of the screen and then maximized - when restored the top of the window border will go under the unity panel.
It will then need to be pulled down to get at the close,min,max buttons ect.

Firefox is clear example though the same should happen to any window if placed directly (touching) below the unity panel before maximizing
With the grid plugin disabled this does not occur

orig. description was wrong, when using grid windows are restored properly
If using the max and restore buttons and the window is touching the unity panel when maxed, then upon restoring window top gets buried
