"Disable touchpad while typing" wrongly enables a disabled touchpad after typing

Bug Description
I am using Ubuntu 9.10 on a Thinkpad z61m.
I usually get the touchpad disabled using <fn>+<f8>. But it always gets reenabled after typing if the option "Disable touchpad while typing" is checked.
Its looking like the option "Disable touchpad while typing" never checks if the Touchpad was enabled before typing in the first place but always enables the touchpad after typing if checked.
The behavior should be like, if I have manually disabled the touchpad, it stays disabled after typing. Independent whether the option is checked or not.
