Bug Description
Build #95
Tested in Nexus 10
Steps to reproduce:
1) Open main stage app (Gallery)
2) Open main stage app (Notepad)
3) Swipe from the left to land into Apps lense
4) Swipe from the bottom
Expected result: Hud should not be available.
Actual result: Hud invocation button appears and Hud can be opened to "gallery" state.

I see an empty HUD action now but it is available
