Summary reports pie charts are broken

Bug Description
If one or more of the chart datasets is empty the script spits the following warning:
Warning: Invalid argument supplied for foreach() in /home/httpd/
The charts do not display even if there's no php warning (i.e. on the live servers)
JS error console reports the following errors:
Error: axis.ticks[i].label is undefined
