nvidia driver 390 fails to build with kernel 6.5

I have kernel 6.5.0-14-generic installed on Ubuntu 22.04.3, and `dkms install nvidia/390.157 -k 6.5.0-14-generic` fails to build with the log attached. This patch may be needed to fix the compilation:

I also see this ticket:

Seems to be independent of the nvidia driver version. I had the problem with 390 and others reported it with 535
