List incorrectly sets a 0 collection size if build depth would be exceeded rather than throwing an exception

With the default build depth settings, a list will check and see that the build depth would be exceeded by attempting to construct its child elements, and return an empty list if there is not sufficient depth remaining. This causes hassles in that if the depth is exceeded, no exception is thrown.
