menubar always visible at startup + weird behavior

Bug Description
When i start marlin the menubar AND the menu-button(the cogwheel on the right) are visble.
when i hit F8 (for hide menubar) the cogwheel goes away, the menu stays
hit F8 again --> the menu disappears and the cogwheel reappears
hit F8 again --> the menu reappears and the cogwheel stays the same
further F8's show and hide the menu, the cogwheel always stays
When i restart marlin it all starts again, marlin doesn't seem to remember that i don't want to see the menubar.
