Kernels newer than 2.6.28-19.66 lock system after 5-10 mins

Bug Description
On any install of a system or use of a kernel past 2.6.28-19 (that I have tried) the system hangs after a short time. First no program will save and no new programs will run and there are msgs (kernel panic I think it's called) on the screen. If in X first the wireless disconnects and asks for WEP password then the USB mouse stops working the finally the laptop's built in mouse and keyboard stops responding (although the graphics and animations onscreen continue to animate) The only recourse I seem to have at this point is hold the power button until the power supply cycles and try to boot again. I think the problem is kernel ATA driver related as it works fine with Mint 7,winXP, Vista, and Win7 and the msg blocks I receive look somthing like this:

Should I give up on newer distros and use the old unsupported ones or is there a fix for this?

Also tried memtest for about 8 hours and came out fine and fully tested the drive for problems and errors and there are none until I install a newer kernel. I also tried removing my mouse (still happens), removed my wireless card (still happens), replaced my ram with spare (still happens), replaced HD with spare(still happens)
