Bug Description
mintWelcome checks for the presence of Ubiquity to decide whether or not to show itself... in the case of an OEM installation, Ubiquity remains on the system so that test isn't good enough.
The launcher should check for the presence of oem-config as well. Alternatively, a check on the username could be made and the assumption that users won't call themselves "oem" or "mint" seems reasonable.
