F.Cu and B.Mask collision in DRC

Bug Description

I have two SMD parts above one another on two different sides (simple two sided pcb, no vias around).
DRC still reports "pad near pad" error.

The problem probably may come from layer changes done when footprint created.
I need arc lines on F.Cu, so I've created shape on a drawing layer (maybe F.CrtYd?) then selected F.Cu layer at edit arc.

I attach video on running DRC, and also attach footprint file (zipped together)

After no reaction of a half year, I re-checked my board design from November 2015 with brand new 7005 nightly KiCad, and DRC problem seems to be gone.
