Selection depth is wrong when only one copy is not under age protect

EG 2.8, 2.10

To produce the issue:

Hold hard boundary: 1
Hold soft boundary: 2

No holdable copy within the soft boundary
All copies but one within the hard boundary are under age protect

to place a title level hold, the selection depth is always wrongly set to 2.

When there are more than one copies not under age protect, the selection depth is set to 1 correctly.

We encountered the issue when there are more than one copies under hold age protect. No pattern. But it seems happening when there are some copies under age protect and some are not.
