Bug Description
A fast and open "replacement for Windows and OS X"
That tag line in the homepage is hurting the elementary brand.
elementary is not a replacement. It is not one of many OSes, it is the OS.
I don't think mentioning Windows and OS X for marketing purpose will be good for a long run.
Not to mention the legal side of it,...

I believe you can come up with tag lines which describe your brand better.
