Touchpad scrolling does not work after system suspend or hibernate

Bug Description

I have a Dell xps 13 Developer edition with Ubuntu 12.04 LTS and kernel version 3.5.0-41. The system works perfect except I have issues with Vertical edge scrolling and horizontal scrolling using touchpad.
The touchpad scrolling sometimes does not respond after the system comes out of Suspend. I have to reboot the system to get it working. Can someone lead me to a solution for this. Appreciate the support.

OS:- Ubuntu 12.04 LTS
kernel:- Dell-System-XPS-L322X 3.5.0-41-generic #64~precise1-Ubuntu

A workaround for this I have identified is to Go to power options and select Do nothing when lid is closed. This will cause not to suspend if the lid is closed but will eventually suspend if it is inactive for more than the time set and the issue will reoccur.

Wanted to know a kernel upgrade will fix the issue??
