merge fails with NoFinalPath

Bug Description

The context is a bit unclear and lead to 31 failures for the package importer.

AFAICS after a first round of diagnosis, this is a regression introduced in 2.2 !

It occurs when a PathConflict involves an item with the same file-id and the same name in two branches with different root-ids.

I.e. the context leading to this bug is hairy and explains why we didn't encounter the problem earlier.

I've got a fix, writing a reproducing test is hard (so "hairy" was an understatement) :-/

I can confirm that 2.1 didn't have the bug and that *this* bug was introduced while fixing bug #531967

This one is also subject to the same micro-release exception and so the test suite passing is enough for verification-done.

Is there really much point in fixing this in maverick now? It has lived most of its live with this bug, and will go EOL in two months.
