To be fair, Apache 1.x doesn't seem to be in portage anymore (for that matter, the ASF isn't going to have any more non-security releases either), so there's no way that one would "accidentally" install a 1.3.x version if one specifies USE=apache.

However, there is a valid point in that maintaining local USE flags is a pain, so I'm switching it for that reason. (Which is also why, unfortunately, the patch you've given isn't quite enough. It's something I learned when official Gentoo devs started to help me maintain the overlay.)

This has been fixed in r351.
