Bug Description

System Settings > Privacy > Diagnostics > Unlock > activate "Send error reports to Canonical" > close the window, then repeat all the steps first and see that the option is not activated.

I am seeing the exact same behavior on my 12.04 desktop. If you leave the Privacy screen and return to it, the "Send error reports to Canonical" checkbox remains unchecked. Note that it does stay checked if you just switch to another tab in the Privacy screen and return to it without closing Privacy.
