I did some testing in Windows and Linux for XQuery 3.0.
For Windows, there were actually 2 more XQuery tests failing.
For Linux I tested only XQueryX and only one supplementary test is failing (w3c_update_testsuite/XQuery/ValTrans/revalidate-valtrans-ins-003) for which I filed a bug on W3C.

I have updated the name of the bug accordingly.

I've checked and from what I see in the processed XQTS, in the
processed_XQTS_13_july/Queries/w3c_testsuite/XQueryX/Basics/EQNames/
there are only .spec files, there are no .xqx tests.

So, IMHO a good starting point would be the
test/rbkt/Scripts/w3c/import_w3c_testsuite.sh
script to see why there are no .xqx tests copied for EQNames.

Before running it though, be sure you change line 4 to:
XQTSURL_DEFAULT=http://dl.dropbox.com/u/4318382/conformance/2011July13/XQTS_current.zip

There is no XQueryX/Basics/EQNames directory in XQTS_current.zip,
although the CVS has it.

This is an old issue related to inconsistencies in XQueryX test-cases from XQTS.
