mint menu looks weird with mint x metal

i am using katya 32 on a dimension 3000
whenever the mint x metal theme is on the menu always looks something like the screenshot below
this is a problem in both compiz and metacity
other themes seem to work fine including mint x (menu-wise that is i have another problem but i think it is separate)
it happens both on the live cd and the install

The menu is not the only graphical interface with the issue for me. Furthermore, it occurs spontaneously for me, unlike the condition for the OP.

i have since determined it goes away if i reinstall X
and reapers if I use compiz fusion
there are more problems that don't rely on the theme (parts of the windows remain when minimised or dissapears, chrome in the upper right (next to resize buttons) turns black)
it's been a while since I've seen it so I might be off a bit
i'll do more specific tests in a vm if a dev is interested
