I've found in the 2.x series that there is no error at all for a future DOB. There is, however, an alert when the DOB does not meet the regular expression and this cannot be bypassed with the same "workaround" as described in the bug.
Perhaps there is a way to have the regular expression on the "dob" field check that the date is not > now?
