menu bar at unity, but original space space it's still there, vertical offset

When I open Evolution maximized, the menu bar goes to the unity task bar, as supposed, but the space of the original menu bar attached at the window it's still present, so the window now has a vertical gap on top, and the pointer position is shifted as if there was no gap, so clicking at one mail will actually click a lower mail on the list, clicking the last mail would click something at the message window, like the email address of the sender, making it very annoying.
