volume slider is disabled when sound is muted

It is not possible to adjust the volume slider when sound is muted. This worked before Maverick.

This forum post shows I am not the only one thinking this is strange :-)

The PC is upgrade to Maverick from Karmic.

seems like it will be fixed in Natty according to a bug report that I cant find right now :(
