Thank you for taking the time to report this problem and help to improve Ubuntu.

You say that this only happens when Update manager is doing an update - does that mean if you run 'sudo update-grub' by hand, it succeeds?

Lucid is no more a supported version; and grub legacy upstream is also stopped, only receiving possible random fixes locally
