Installation of Jaunty wouldn't complete on drive with ext3 file system

Bug Description
I was attempting to do a fresh dual-boot install of windows xp and ubuntu 9.04. The original installation was successful. But because of partitioning issues not associated with either os, I just decided to partition the drive differently, I had to do a reinstall. When I tried to reinstall ubuntu to the previous ext3 partition, the installation would fail when trying to install grub.
Config: 500GB HDD w/ 12GB WinXP partition, 150GB Ubuntu partition, 2.5GB Linux swap partition, Balance = shared drive, installation successful.
Reconfig: w/ 12GB WinXP partition, 150 Ubuntu part (retained ext3 filesystem), 2.5GB swap, 4 x 75+GB part, installation failed.
Reconfig: w/ 12GB WinXP part, 2.5GB swap, 150 Ubuntu part (no filesystem), 4 x 75+GB part, installation successful.
