crashing processes dont let go of webcam

every programme i have try from cheese to gst-launch will crash when i try nand record locally from it. when this happens the programme either becomes unkillable or becomes a zombie in either case it retains hold of the /dev/video0 and not even a kill -9 works on it

somethings i forgot before. i am on jaunty 64 bit i do not remember which kernel but i am presuming latest since i keep up on my updates and the bug effects programmes when i try to record or capture an image from my webcam. my webcam is a logitech quickcam communicate stx but this also happened with a flexcam 100. gstreamer-properties get data from the webcam oddly camstream does not but an6y atempt to record from it crashes the programme and i will be unable to get it to release the webcam or die
