xen-3.2 hvm console save/restore patch missing in hardy

I've got exactly this problem with hardy/xen-3.2/2.6.24-22-xen:

at startup, the tty console is connected to the xen-hvm DomU, but after save/restore, or livemigrate, it's not attached anymore and only the vnc console remains.

There seems to be a patch out there, which has not been applied to the ubuntu version (yes, I am using hardy-updates ;) ):
