These were all existing partitions when installing 8.10 over 8.04. I selected manual partitioning and edited sda6 to set it to ext3, format and mount at /. Clicked continue and after it formatting sda6 it complained that the installer was unable to use sda5 as swap. I've been using these same parition's since before the 7.x releases so its definitely something new with the installer.

Few details I left out:

After the installer complained it took me back to the partition wizard. I selected manual again and I set the swap partition not to be used. I just configured the swap manually in the fstab once I got 8.10 installed.

This is still broken in 9.04. I'm the only person re-installing over an existing set of partitions including a swap who has had this experienced? If someone knows another bug of which this is a dupe please let me know or mark it as such. This is pretty ridiculous.
