ipw2100 firmware missing after first kernel update

Bug Description

Issue exists on xubuntu live-current 2-23, 3-4 and 3-15.

IPW2100 firmware is missing after installing the first kernel update available on a new installation, but works after the second update.

Steps to reproduce:
1). Install xubuntu.
2). Reboot. IPW2100 wireless works fine.
3). Check for updates, if kernel update is available, install it.
4). Reboot. firmware fails to load when ipw2100 is modprob'ed (with either disable=0 or 1)
5). Check for updates, install kernel update if available (might have a wait a day).
6). Reboot. IPW2100 works fine.

Last time I noted this issue I placed the logs in /var which got hosed after my 3-15 install. I'll try to post some logs after next install.

Thank you for taking the time to report this bug and helping to make Ubuntu better. You reported this bug a while ago and there hasn't been any activity in it recently. We were wondering is this still an issue for you? Can you try with latest Ubuntu release, Hardy 8.04? Thanks in advance.

I am using 8.10 Intrepid Ibex and the firmware is missing - no updates are yet available, this is a fresh installation

I downloaded the firmware from http://ipw2100.sourceforge.net/firmware.php and extracted it into /lib/firmware/2.6.27-7-generic/

1) Why isn't the firmware included? Because of the proprietary driver license?
2) Shouldn't at least a notice be there?

The LiveCD and MinimalCD have such firmware, while the installed Ubuntu has not...this is clearly a bug to me

I also can confirm this bug. I did a dist upgrade from hardy to ibex and now ipw2100 firmware fails to load. Here is what dmesg says about it:
