nvidia-331 331.113-0ubuntu2: nvidia-331 kernel module failed to build

$sudo apt-get update
$sudo apt-get upgrade
$sudo apt-get dist-upgrade

the system tried to update kernel to -9 and the automatic process to report errors started.
