menu key problem

When the Menu Key is pressed (on the keyboard) it opens a context menu/app, when i press it again (without closing the first context menu) it generates another context menu, and doesnt delete the first one. It does NOT replace the first context menu, when creating another one.
That happens only in the desktop and nautilus
