AR9462 Atheros packet loss with android hotspot

Bug Description

I just got a dell xps 13 developer edition. unfortunately the wifi does not work well so I upgraded to ubuntu 13.04 but no luck.

 Read that the problem is fixed in the 3.11 kernel but it is not. I installed http://kernel.ubuntu.com/~kernel-ppa/mainline/v3.11.5-saucy and still doesnt work. Then I installed the 3.12 kernel http://kernel.ubuntu.com/~kernel-ppa/mainline/v3.12-rc5-saucy/
still has high packet loss. However if I turn off security on my android hotspot (no WPA) I get no packet loss.
