No graphical screen and no sound when overlayroot is active

Bug Description
I installed overlayroot on a clean 13.04 on a USB drive and activated it by configuring overlayroot="tmpfs" to overlayroot.conf.
At boot, sometimes (50%) there is no graphical screen (in auth.log pam_unix complains that lightdm conversation failed). Also sound does not work (a dummy driver is in the sound settings). Also sometimes the system does not boot (kernel panic: unable to handle kernel paging request at ffff88013494ffe0).
When overlayroot is deactivated using the kernel parameter "overlayroot=", then the system works well.
