This error comes up when I am doing any software updater.

Unfortunately, the xemacs21 package on Ubuntu is old and not very actively maintained. If it is at all an option for you, please consider switching to emacs24 (GNU Emacs). Either way, ESS is apparently no longer supported on XEmacs. The upstream package is going to drop the xemacs21 support, but the upload is apparently still pending.
