Application titlebar not clickable in fullscreen mode

When i open an application and this application starts directly within fullscreen mode (like the file manager). The titlebar elements (min, max, close, menu and the bar it self) are not clickable / draggable, it will click "through". If i switch from fullscreen to a different size and then back to fullscreen again, it works perfect.
Explaination of "click through": if i have no applications opened and open file manager which directly is in fullscreen i can get the desktop right-click menu if i right click on the titlebar within the fullscreen file manager.

Re-produce:

* Open file manager, check if it is directly maximized (fullscreen) if not, do maximize
* Close the file manager
* Open the file manager, now it should be maxmized directly.
* Try to minimize through the titlebar button

expected: Window should be minimized
result: Nothing happens or if there is another window behind this window will be focused.

It worked flawless on ubuntu 12.10, it just started after i upgraded yesterday to 13.04
