panel overlaps top of menu+menu doesn't work when bottom orientation

Bug Description
I am using GnoMenu 2.9.1, Ubuntu 11.04 and the top panel hides the top part of the menu, I cannot give you a screenshot because if I do FN+PrintScreen the menu hides.
The other bug is that when I change the panel orientation to the bottom and I click on GnoMenu the menu will not show up.
