Unity's default File Manager toolbar overlaps application description

When file manager is open and NOT maximized, if I hover with the mouse, on the menu in the top bar, it only partially overlaps applications description/name leading to an unestetic overlap effect. see picture.

Expected: Close/minimize buttons should appear like when application is maximized,

I'm sure this is a duplicate because the issue has come up before. I just can't find the original bug right now.

But the application is not maximize why would those buttons appear in the panel?

Window controls should not come up on the panel when an application is not maximized. This is intended behaviour according to the design spec.

Marking opinion; feel free to discuss and state why you feel window controls should appear and the application name should disappear completely when hovering over the panel in this state.
