Accessing menus difficult when "focus follows mouse" enabled

First off, I realise that having the focus following the mouse is not the standard behaviour. I also realise that I can't set it without installing an advanced settings editor or knowing which settings to twiddle in gconf. That said, it is also a feature that (up until now) has be very useful and generally improved my productivity.
The issue I am seeing is that because the menu (which is now presented in the bar at the top of the screen) changes as focus changes, when I traverse the screen with the mouse to get to it by the time I have got there from an unmaximised application, the menu is not the one I needed. This is compounded by the fact that applications pushed against the menu bar seem to automatically get maximised, so quickly dragging the screen near the bar (in it's self a pain) results in more fighting with the GUI.
This seems to be fixable by having the menu be provided by the foregrounded application rather than that which last had focus. Since the default behaviour is for click to focus, which also foregrounds the application, then I think the default behaviour would remain the same whilst providing support for alternative ways of working.
