Bug Description

Please cherry-pick 2c670b5 from upstream for oneiric. It closes a race that can cause link negotation to fail.

[Impact]
Severity: high; network does not obtain link
Frequency: rare

[Development Fix]
commit 2c670b5

[Stable Fix]
Trivial cherry-pick from upstream

[Test Case]
Not easily reproducible

[Regression Potential]
Minimal; code is very isolated, stable upstream, and we've been using it in an OEM project for several months w/ no problems.

For this request, can you create a SRU bug (just adding some text to this one would work). Then make a request on the kernel team mailing list:

I've added the necessary content to the Description field, but I do
not have access to the "Nominate for series" feature described on:
  https://wiki.ubuntu.com/StableReleaseUpdates?action=show&redirect=SRU

Can you help me out there?

I'll wait until the SRU tag is added to do this unless told otherwise.

This bug is awaiting verification that the kernel for Oneiric in -proposed solves the problem (3.0.0-15.24). Please test the kernel and update this bug with the results. If the problem is solved, change the tag 'verification-needed-oneiric' to 'verification-done-oneiric'.

If verification is not done by one week from today, this fix will be dropped from the source code, and this bug will be closed.

See https://wiki.ubuntu.com/Testing/EnableProposed for documentation how to enable and use -proposed. Thank you!
